Terms and Condition

1. Introduction

Welcome to Marketplace Africa. These Terms and Conditions (“Terms”) govern your access to and use of our platform, which facilitates the sale of excess inventory and surplus goods through both direct sales and auction formats. By accessing or using our services, you agree to comply with these Terms. If you do not agree, please discontinue use of our website and services immediately.

2. User Eligibility

To register or use our services, you must be at least 21 years of age or older. By creating an account, you represent that all information provided is accurate, complete, and up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3. Role of Marketplace Africa

Marketplace Africa operates as an online facilitator that connects buyers with products from retailers due to overstock, and items stores simply do not want anymore, including retailers and manufacturers offloading surplus inventory. We do not own or manufacture the goods listed on the platform and are a party to transactions between buyers and us as the seller only. We provide a secure and transparent platform through which these transactions can occur.

4. Fees and Payments

  • There are no hidden fees or charges. additional fees will apply to shipping, import taxes etc. But the price you pay/win for the auction or items ordered is the price you pay. 

  • Buyers must submit payment within the specified timeframe after winning an auction or confirming a purchase. This is 3 days unless otherwise stated. Payment and pickup details are provided to the buyer upon winning or purchasing your order. 

  • Non-payment, chargebacks, or failed transactions may result in penalties, including suspension or permanent termination of accounts.

5. Bidding and Listing Rules

  • All bids are binding. Placing a bid signifies a genuine intent to purchase if successful.

  • Any attempt to manipulate auctions—including false bidding, or artificial price inflation is strictly prohibited and will result in immediate suspension.

6. Shipping and Returns

  • Buyers are responsible for reviewing shipping details, timelines, and costs before finalizing a transaction.

  • Buyers are responsible for shipping items to their home country. Marketplace Africa is only responsible for providing the goods and loading the goods unto your container or on your shippers truck. Beyond loading of all goods and confirmation by your pickup driver Marketplace Africa does not have any responsibility of the items. Responsibility shifts to your shipper. We highly recommend you get shipping insurance to product your shipment. 

  • Buyers may NOT RETURN ITEMS. ALL SALES ARE FINAL WITH NO RETURNS. If you win an auction or pay immediately for any items and they leave the warehouse they can not be returned.

  • Penalty for not paying for items you won or purchased will result in your account being closed or suspended. 

7. Prohibited Activities

Users must not engage in any of the following:

  • Using fraudulent or unauthorized payment methods

  • Harassing, abusing, or defrauding Marketplace Africa

  • Attempting to exploit, reverse-engineer, or disrupt the platform’s operations or security features

Violations may lead to immediate account suspension, legal action, and permanent bans.

8. Account Suspension and Termination

Marketplace Africa reserves the right to suspend, limit, or terminate any account that violates these Terms or engages in unethical or illegal behavior. Actions may be taken without prior notice and at our sole discretion. Marketplace Africa also has the right to terminate users at any time for any reason. 

9. Limitation of Liability

Marketplace Africa acts solely as a facilitator and assumes no liability for:

  • Delays, losses, or damages resulting from shipping or handling

  • Disputes between shipper and buyer

Buyers acknowledge that they participate in transactions at their own risk. However, we are committed to ensuring all items purchased or in new and or listed condition and are undamaged at the time of shipment. 

10. Modifications to Terms

We may update or revise these Terms at any time. All changes will be posted on this page, with the effective date clearly stated. Your continued use of our platform after any such updates signifies acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal disputes shall be handled in a court of competent jurisdiction in that region.
